User Agreement

 

  1. GENERAL PROVISIONS

1.1 This User Agreement (the “Agreement”) applies to the website of Severnoe Siyanie LLC, located at: https://myaurora51.com/

1.2 The website https://myaurora51.com/ (the “Website”) is owned by Severnoe Siyanie LLC (OGRN 1185190006968, TIN 5190078636; 2a Energetikov Street, Tumanny urban-type settlement, Kola District, Murmansk Region, 184375, Russia).

1.3 The Agreement governs the relationship between the Website Administration at https://myaurora51.com/ (the “Website Administration”) and Website Users.

1.4 The Website Administration may amend, add or remove provisions of the Agreement at any time without notifying the User.

1.5 The User’s use of the Website constitutes acceptance of the Agreement and the amendments made to it.

1.6 The User is personally responsible for checking the Agreement for amendments.

  1. DEFINITIONS

For the purposes of this Agreement, the terms below have the following meanings:

  • “Severnoe Siyanie Outdoor Recreation Park” is an online resource located at https://myaurora51.com/
  • “Severnoe Siyanie Outdoor Recreation Park” is a website containing information about the activities of Severnoe Siyanie LLC, its services and other offerings for users, and the service provider, and allowing users to select, order and purchase services and obtain information.
  • Website Administration means employees authorized to manage the Website and acting on behalf of Severnoe Siyanie LLC.
  • Website User (the “User”) means a person who has access to and uses the Website.
  • Website Content (the “Content”) means protected intellectual property, including literary works and their titles, forewords, abstracts, articles, illustrations and covers; musical works with or without lyrics; graphic, textual, photographic, derivative, composite and other works; user interfaces and visual interfaces; trademark names, logos, computer programs and databases; as well as the design, structure, selection, coordination, appearance, overall style and arrangement of the Content on https://myaurora51.com/, and other intellectual property, individually and/or collectively.
  1. SUBJECT OF THE AGREEMENT

3.1 The subject of the Agreement is to provide the User with access to information on the Website and to the services offered.

3.2 The Website provides the User with the following types of services:

  • providing the User with information about the activities of Severnoe Siyanie LLC and the services, products and offerings it provides;
  • selecting a service and placing an order for it;
  • pre-booking a service. A pre-booking is a public offer; its terms and implementation procedure are set out on the Website at: https://myaurora51.com/The Website Administration may change the pre-booking terms at any time. New terms take effect once published at: https://myaurora51.com/For people who have accepted the public offer, the pre-booking terms in effect at the time of acceptance remain valid.

3.3 This Agreement applies to all services currently operating on the Website, any subsequent modifications to them, and any additional services introduced in the future.

3.4 Access to the Website is provided free of charge.

3.5 This Agreement is a public offer. By accessing the Website, the User is deemed to have accepted the Agreement.

3.6 Use of the Website’s materials and services is governed by the laws of the Russian Federation in force.

  1. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1 The Website Administration may:

4.1.1 Change the rules for using the Website and its content. Changes take effect when the revised Agreement is published on the Website.

4.2 The User may:

4.2.1 Use all services available on the Website and purchase any goods and/or services offered there.

4.2.2 Ask any questions relating to the Website’s services by email at sevs51@mail.ru or via the feedback form available at: https://myaurora51.com/

4.2.3 Use the Website only for the purposes and in the manner provided for in the Agreement.

4.3 The User undertakes to:

4.3.1 Provide, at the request of the Website Administration, additional information directly related to the services offered on the Website.

4.3.2 Respect the economic and moral rights of authors and other rights holders when using the Website.

4.3.3 Refrain from actions that may be considered disruptive to the normal operation of the Website.

4.3.4 Not use the Website to distribute confidential information about individuals or legal entities that is protected under the laws of the Russian Federation.

4.3.5 Avoid any actions that could compromise the confidentiality of information protected under the laws of the Russian Federation.

4.3.6 Not use the Website to distribute advertising information without the consent of the Website Administration.

4.3.7 Not use the services for the purpose of:

4.3.7.1 Impersonating another person or representing an organization and/or community without sufficient authority, including employees of this Website.

4.3.7.4 Misleading others about the properties or characteristics of any service and/or offering posted on the Website.

4.3.7.5 Unfairly comparing services and/or offerings, or creating a negative attitude toward people who do or do not use particular services and/or offerings.

4.3.7.6 Uploading content that is illegal or infringes third-party rights; promotes violence, cruelty, hatred and/or discrimination based on race, nationality, sex, religion or social status; contains false information and/or insults directed at specific people, organizations or government bodies.

4.3.7.7 Inciting unlawful acts, or assisting people whose actions are aimed at violating restrictions and prohibitions in force in the Russian Federation.

4.3.8 Ensure that the information provided is accurate.

4.3.9 Protect personal data from access by third parties.

4.4 The User is prohibited from:

4.4.1 Using any devices, software, procedures, algorithms or methods, automated devices or equivalent manual processes to access, acquire, copy or monitor Website content.

4.4.2 Disrupting the proper functioning of the Website.

4.4.3 Circumventing the Website’s navigation structure by any means to obtain or attempt to obtain information, documents or materials through means not specifically provided by the Website’s services.

4.4.4 Gaining unauthorized access to Website features, other systems or networks related to the Website, or any services offered on the Website.

4.4.5 Breaching the security or authentication systems of the Website or any network related to it.

4.4.6 Performing reverse searches, tracking or attempting to track any information about another Website User.

4.4.7 Using the Website or its content for any purpose prohibited by the laws of the Russian Federation, or encouraging any unlawful activity or other activity that infringes the rights of the Website Administration, Website Users or third parties.

  1. USE OF THE WEBSITE

5.1 The Website and its content are owned and operated by the Website Administration.

5.2 Website content is protected by copyright law, trademark law, other intellectual property rights and unfair competition law.

5.3 This Agreement also applies to any additional provisions and terms governing the receipt of information and ordering of services offered on the Website.

5.4 Information published on the Website must not be construed as an amendment to this Agreement.

5.5 The Website Administration may change the list of services and offerings on the Website and/or their prices at any time without notifying the User.

5.6 The document referred to in clause 5.7 of the Agreement governs, in the relevant part, the legal relations between the Website Administration, Website Users and third parties, and applies to the User’s use of the Website.

5.7 Privacy Policy:

5.8 Any document listed in clause 5.7 of the Agreement may be updated. Changes take effect when published on the Website.

  1. LIABILITY

6.1 The Website Administration will not compensate for any losses the User may incur through an intentional or negligent breach of any provision of the Agreement, or through unauthorized access to another User’s communications.

6.2 The Website Administration is not liable for:

6.2.1 Delays or failures in a transaction caused by force majeure or any failure in telecommunications, computer, electrical or other related systems.

6.2.2 The actions of transfer services, banks or payment systems, or delays related to their operation.

6.2.3 The proper functioning of the Website if the User lacks the technical means required to use it; the Website Administration is not obliged to provide Users with such means.

  1. BREACH OF THE USER AGREEMENT

7.1 The Website Administration may disclose information about the User if such disclosure is required or permitted by the laws of the Russian Federation in force.

7.2 The Website Administration may, without prior notice to the User, terminate and/or block access to the Website if the User breaches the Agreement or the terms of use contained in other documents, if the Website ceases to operate, or due to a technical fault or problem.

7.3 The Website Administration is not liable to the User or third parties for termination of access to the Website if the User breaches any provision of the Agreement or another document containing the Website’s terms of use.

  1. DISPUTE RESOLUTION

8.1 In the event of any disagreement or dispute between the Parties, filing a claim (a written proposal for voluntary settlement) is required before bringing the matter to court.

8.2 Within 30 calendar days of receiving a claim, its recipient must notify the claimant in writing of the outcome of its review.

8.3 If a dispute cannot be resolved voluntarily, either Party may apply to a court to protect its rights under the applicable laws of the Russian Federation.

  1. ADDITIONAL TERMS

9.1 The Website Administration does not accept counterproposals from the User concerning amendments to the Agreement.

9.2 User reviews posted on the Website are not confidential information and may be used by the Website Administration without restriction.
